Rental Agreement

The following is the online Mermaid Cottages Rental Agreement which you’ll be asked to agree to when making your online Reservation.   The Rental Agreement is a legally binding agreement between Guest, Mermaid Cottages and the Property Owner. Your reservation and signed Rental Agreement binds you to a specific property for a specific period of time.

Reservation Policies
All reservations made within thirty (30) days from arrival date require full payment at the time the reservation is placed.

Methods of Payment
We accept personal checks, credit cards (Visa or MasterCard), traveler’s checks, money orders, or cashier’s checks. All returned checks will be charged a $25.00 fee and we will not re-deposit any returned checks.  Checks should be made payable to “Mermaid Cottages, LLC.”  Our mailing address is Mermaid Cottages, P.O. Box 2677, Tybee Island GA 31328.

Advanced Deposit and Final Payment
An Initial Payment of 50% of the Total Rental Balance is due at the time your reservation is made.  Final Payment is due in full 30 days prior to your arrival date, after that date, we cannot accept personal checks for Final Payments. We will not send you a reminder for your final payment, so please be sure to mark this date on your calendar. You may choose to have us bill the payments to your Visa or MasterCard on the due dates.

Accidental Damages

We have eliminated the security deposit for 2013. Accidental damage can and does occasionally occur, just as it does in your own home. Under our Damage Protection Waiver included in your reservation fee, you will not be charged for accidental damage to the home or the personal property of the owner contained within the home, up to a limit of $1,500 per reservation. Mermaid Cottages will assume responsibility to repair or replace accidental damage as needed. This damage protection benefit does not negate your responsibility as a tenant to take care of the rental home and report any accidental  damage immediately. Damage Protection does NOT cover intentional damage, theft, gross negligence, pet damage, pay-per-view cable charges, Acts of God or loss of use. Any accidental damage must be reported to our office immediately and before the end of your stay in order for Damage Protection to apply.

After guest departure, a Mermaid Cottages inspector will carefully inspect the home to ensure that it is left reasonably clean and free of unreported damage. Guests will be notified of any excessive damage/costs in writing. Guests authorize Mermaid Cottages to charge guest’s credit card in the event of the following: intentional damage, theft, unintentional and incidental damage exceeding the $1,500 coverage, any damage or flea infestation caused by a pet, unauthorized pets, excessive cleaning after departure, smoking in non-smoking homes or exceeding occupancy or parking limits.

We reserve the right to charge a security deposit for events or for reservations by non-traditional groups.

Damage Waiver Fee/ Reservation Fee

Each reservation includes a $69 Damage Waiver Fee/ Reservation Fee.   This is a non refundable fee ( NOT DEPOSIT) which
take the places of the security deposit.

Damages, and Missing Items
Guest authorizes Mermaid Cottages, LLC to charge Guest’s credit card in the event of the following: intentional damage, theft, excessive cleaning after departure, unintentional and incidental damage exceeding the amount of coverage purchased, any damage or flea infestation caused by a pet, unauthorized pets, property damage, extensive cleaning required at check-out, smoking in non-smoking units, exceeding occupancy or parking limits, and any other mentioned charges/policies in Mermaid Cottages Rental Agreement. Guest will be notified of any damage/costs in writing. Any material damage to the Rental Property will be charged immediately to the Guest’s credit card. Guest, in signing this agreement, assumes full responsibility for any items damaged due to misuse or negligence or action on guest’s part, except in the case of normal wear-and-tear reported to Mermaid Cottages within 24 hours of check-in, and for any items found to be missing. Guest is responsible for notifying Mermaid Cottages immediately upon check-in if the Rental Property is found in less than good condition or any damage is noted. If damages occur during your stay, please notify us immediately.

Damage
We ask our guests to report any breakage or damages to us upon occurrence, prior to check out and settle the matter prior to leaving. If there is any damage to the Rental Property or its furnishings, the Guest does agree to be responsible for the cost to repair any damages done by either Guest, Guest family, or Guest pet. All Rental Properties are inspected after each Guest by a property inspector and reported to Mermaid Cottages for appropriate billing.

Refunds
The Rental Agreement is a legally binding agreement between Guest, Mermaid Cottages and the Property Owner. Your reservation and signed Rental Agreement bind you to a specific property for a specific period of time. There should be no expectation of refunds or relocation because you are disappointed with the property you have rented or in the event that something associated with the property is not working to your satisfaction. Unlike a hotel, we cannot relocate you without specific authorization from the Property Owner. We will make every attempt to correct any problem that arises during your stay in a timely manner. There will be no refunds for mechanical failure of items such as air conditioner, TV, dishwasher, washer/dryer, or other luxury items.

Cancellation Policies and Fees
Once a reservation has been confirmed by payment and you are unable to fulfill your obligation to occupy the Rental Property, Mermaid Cottages must be notified as soon as possible. We require all cancellations be in writing for your protection. Mermaid Cottages will make every attempt to re-rent the property once we have received notification of cancellation. If we are unable to re-rent the property, no refunds will be due. If the property is re-rented at full Rental Rate, you will receive a refund of the full amount of rent consideration (rent, taxes, and Damage Waiver Fee) less a $150.00 Cancellation Fee.
Please note: Trip Cancellation Insurance premiums paid (if applicable). If you have purchased Trip Cancellation insurance at the time of making your reservation please refer to your policy for instructions on recovering your loss dueto cancellation. In no event shall Guest assign or sublet the Rental Property in whole or in part.

Travel Insurance

Mermaid Cottages has contracted with Red Sky Travel Insurance, 866-889-7409, in order to offer you trip cancellation insurance to protect your vacation investment against hurricane evacuations, injury, sickness, job loss*, or death and other unforeseen covered circumstances, which could cause cancellation of confirmed reservation and forfeiture of payments.  The optional trip cancellation insurance cost is 6.9% of the total Reservation charges and is automatically included in the Total Balance Due on the Reservation Confirmation and can be purchased either at the time of making the reservation or prior to paying your Final Balance.  Payment for the plan will not be accepted after Mermaid Cottages has received your Total Balance Due.  You are required to indicate choice to accept or decline optional trip insurance on the Rental Confirmation and Rental Agreement.

We recommend that all Guests purchase this coverage for added financial protection in cancellation situations where we are unable to refund payments.  You will have 10 days from the date you receive the trip cancellation policy to review the policy and cancel, in writing, if you do not elect to purchase this coverage.  Refunds and coverage issues will be based and determined solely by Red Sky Travel Insurance and the existing policy will be issued to Guest if coverage of this insurance has been elected upon making reservation.

Hurricane/Weather Evacuation
In the event of an ordered evacuation due to hurricanes or other storms, you are required by state law to evacuate property.  If you have declined trip cancellation insurance, you shall not be entitled to a refund. Refunds and coverage issues will be based and determined solely by Red Sky Travel Insurance and the existing policy will be issued to Guest if coverage of this insurance has been elected upon making reservation. Refunds for the period of mandatory evacuation will be made solely by Red Sky Travel Insurance, provided Guest has purchased optional trip cancellation insurance. Refer to trip cancellation policy or contact Red Sky Travel Insurance directly for specific information and/or refund procedures. If you choose to leave due to “Storm Warnings” or “Voluntary Evacuation” no refunds will be given. Mermaid Cottages will not issue refunds in part or in full for inclement weather. Our recommendation for travels during hurricane season is for you to research and purchase trip cancellation insurance.

Indemnification
The Guest agrees to indemnify the owner for any damages to or loss from the rental house, grounds, furnishings, appliances, household items and any other of the Owner’s property resulting during the Guest’s rental term, normal wear and tear excluded. The Guest further agrees to indemnify and hold the owner and the rental agent ( Tybee Mermaid, LLC and Mermaid Cottages, LLC) harmless from any claim or liability for any loss or damage whatsoever arising from, related to or in connection with the rental of this rental property, including but not limited to any claim for personal injury or damage or loss of property which is made, incurred or sustained by the Guest or other occupants or invitees of Guest, excepting if such damage or loss results directly from the willful misconduct or sole negligence of the owner or the agent. Neither the owner nor the agent are responsible for any of the Guest’s or other occupant(s) valuable, cash or other property during the rental term or thereafter left at the rental house.
Important:
Rental Properties are for family vacations only: Mermaid Cottages gladly rents to families or responsible adults over the age of 25 years old. Mermaid cottages has a “No-Group” Policy, which includes but is not limited to the following: school, spring break, prom, graduation, wedding receptions, etc. Mermaid Cottages may approve at the time of reservation and at our discretion to rent to groups, but you must disclose at the time of reservation 1) that you are a non-family group, and 2) the majority of the group members must be at least 25 years of age. Absolutely no house parties, events, receptions, or kegs!

City Code Regarding Events: “Under the zoning and other ordinances of the City of Tybee Island, it is unlawful to advertise or otherwise promote, or to hold out for availability, any location that has not been specifically approved as a special event location for conducting weddings, reunions, or similar events. Such activities are not permitted uses under the Land Development Code, 4-050. This is true for bed and breakfast establishments as well as residential structures. Procedures for seeking approvals of special event locations can be secured from City Hall on properties located within appropriate zoning districts. Should you have any questions, please contact the Building and Zoning Department of the City.”

Maximum Occupancy & Parking Capacity: Mermaid Cottages has set and published occupancy & parking limits for every unit and strictly enforces these limits. The Maximum Occupancy listed as “Property Capacity” is determined by the bedding provided in the Rental Property and/or the limit set by Mermaid Cottages and the Owner of the Rental Property. The number of available off-street parking spaces determines the Parking Capacity.

Absolutely No House Parties! And No Kegs!  House Parties are strictly forbidden and overcrowding is not permitted. We strongly advise you to not jeopardize your family and friends’ vacation by overcrowding or noise violations.

MERMAID COTTAGES RESERVES THE RIGHT TO REFUSE SERVICE TO ANYONE: All rental properties are leased without regard to race, color, religion, sex, national origin, handicap or sexual orientation.

Keys:
Each home will be given 3 keys. A replacement charge of $20 per key will be applied to lost keys.

Items Left Behind:
We will contact you regarding anything left behind. Should you wish to have the items returned, we will make arrangements with the Tybee Island UPS Store to contact you and arrange for payment and shipping directly.

Important To Note:
No illegal substances are permitted on the property.
Quiet time – the noise curfew is 10PM in all residential areas and all guests are expected to comply.

Pet Policy:
If you are bringing your pet, please review our Pet Policies. Main points:
Please do not leave the dog(s) outside in the yard unattended. Tybee does have a noise ordinance and this does include dog barking. The fine is $300.
Flea and tick protection – fleas are here on Tybee in full force, please be sure your animals are current on their flea protection medicine.
Don’t forget- dogs are NOT allowed on Tybee Beaches at any time of the year.

  • Pets are not allowed on the furniture or beds.
  • Please clean up any pet “poo” in the yard.
  • Crates: if you are bringing a dog under the age of 1 year, we ask you to crate the dogs when you’re not there. We also ask that you do not leave older dogs by themselves to have the run of the home when you are gone.
